                   AN ORDINANCE TO AMEND ORDINANCE NO. 9464
                   ENCAPTIONED, "AN ORDINANCE CLOSING AND
                   ABANDONING A PORTION OF CORNELIA ALLEY LOCATED
                   NORTHEAST FROM WEST 19TH STREET, BETWEEN MARKET
                   STREET AND LONG STREET, MORE PARTICULARLY
                   DESCRIBED HEREIN, UPON CERTAIN CONDITIONS." SO
                   AS TO AMEND ONE OF THE CONDITIONS THEREIN.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9464, encap- 

         tioned as set forth above, be and the same is hereby amended by 

         deleting therefrom condition number 1 in Section 2 in its 
entirety
         and inserting in lieu thereof the following:
              1.   The City of Chattanooga has a sewer located within
                   said right-of-way and reserves an easement the
                   width of the right-of-way for the purpose of
                   maintaining said sewer; provided, however, that
                   said easement shall be deemed abandoned upon
                   completion by the applicant of capping of the
                   manhole at the end of said right-of-way in a manner
                   approved by the City Engineer and upon applicant's
                   execution of a release of all claims to the City.
             
               	   SECTION 2.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
